Lessig produced utterances which, because they are not fixed in a tangible form, are uncopyrightable. Somebody else created the recording which, being so fixed, is copyrightable. That somebody owns the copyright; Lessig, who lost a copyright case at the Supreme Court, does not.

He can repeat this falsehood as much as he wants, but repetition does not make it true, or even, to use the Colbertese, truthy.
