I figured recent events in the Boston area, elites running into legal trouble, at the hands of common citizens would bring hiim out.

BOSTON — A Boston University student has been ordered to pay $675,000 to four record labels for illegally downloading and sharing music. Joel Tenenbaum, of Providence, R.I., admitted he downloaded and distributed 30 songs. The only issue for the jury to decide was how much in damages to award the record labels.

Although I think Lessig is on record as saying the Harvard prof’s attempted legal defense of fair use was stretching it, but Lessig was arguing for jury nullification.

In Harvard I guess that they did not teach not talking back to the police, or if you are going to steal music (and people did it with cassettes decades ago) don’t do it in public and don’t sell pirated cassettes on the street. Also take things lawyers or politicians say, not as 100% lies, but with skepticism.

(maybe you’ve even seen it before!).

Having my experience from the free software movement, I’m critical of Attribution-NonCommercial licenses put out by Creative Commons, since their non-free. The benefit of the free software definition, as opposed to Creative Commons (lack of one), is it avoids the hair splitting possibilities of “commercial advantage or private monetary compensation”. Besides sidestepping possible confusion of “commercial purposes”, the free software idea has the added side effect of granting freedom — to use the work “for any purpose”. Even nuclear warfare.
