I totally agree with your closing point regarding the corrosive and corrupting effect of constantly living against the law (even if that law is an ass), and that this sort of corruption in the end can have a fatal effect on democracy, or on any resimler sort of belief and a prayer, which democracy devolves to if it’s not upheld by laws. That way be cynicism, which is as bad as dragons

After graduating with an LL.M. I went on to lecture at the Anglo-American University in Prague. I found your book “Code and other Laws of Cyberspace” quite enlighting and ordered a few dozens for my Cyber-Law class. I supplemented it with eBusiness Legal Handbook (Michael Rustad and Cyrus Daftary). I am looking forward to your new book. Albeit I am yet to read your new book, I agree that there must exist a healthy balance between “fair use exception” and “infringement” Ceteris paribus.

Your argument in this book would appear to be along these lines. What distresses us is copying pure and simple with no value added, for the purpose of getting something for nothing instead of paying a price in the marketplace; that, we believe, is theft and not sanctioned by fair use at all. I hope your book will acknowledge that distinction between “creative” and “duplicative” copying. By the way, at the end of “The Future of Ideas” you said that the distinction between commercial and noncommer4cial use cannot be sustained in the Internet age. So how come Creative Commons made this distinction central to the Creative Commons licensing scheme?
