Brennan Center on Fair Use

The good stuff on “fair use” just won’t stop coming (if only now we could get some good judicial decisions). The Brennan Center at NYU Law School has a great new report. Download it here.

It all boils down to the law. We can debate on whether something is fair use or not all day, but it doesn’t do much good. Fair use law, as it is now, stacks the deck against the people who wish to exercise it. What we need is (like you say) judicial decisions, and even more so, clarifications (and changes) in copyright law.

We need more statutory licenses. Fair use was never meant to be used for the purposes it’s being used for today.
